Mediation

In addition to its litigation practice, the firm offers mediation services to help parties resolve contentious disputes efficiently and cost-effectively.

For over 20 years, David M. Pohl has litigated successfully on behalf of clients and continues to do so. Because many disputes call for constructive, creative problem-solving with a third-party facilitator, David serves as a neutral mediator.

Successful mediation of disputes results in substantial savings in time, cost, and emotional toll. Unlike court proceedings, mediation empowers parties to tailor their own resolutions through a collaborative process that addresses what matters most to each party and allows them to resolve their dispute and get back to their business endeavors.

David’s mediation practice centers on creating genuine understanding through patience, thoughtful engagement, and active listening. He facilitates the communication necessary for productive conflict resolution – enabling parties to craft durable resolutions consistent with their core concerns and interests.

As a neutral mediator, David draws on the same diligence, care, and preparation that has made him a successful litigator and advocate. His analytical skills and deep familiarity with the litigation process enable him to help parties understand their best-case and worst-case outcomes if settlement cannot be reached.

David mediates disputes across a broad range of commercial and employment disputes. He adapts his style to the nature of each dispute – providing facilitation when parties need space to communicate and direct reality-testing when disputes require candid assessment of courtroom risks. This flexible approach enables him to help parties resolve conflicts efficiently and effectively.

In addition to his two decades of litigation experience, David has completed all required mediation training under 22 NYCRR Part 146, which governs standards and procedures for mediators in New York State.
