Our Approach

We represent financial institutions, businesses and individuals in high-stakes disputes, litigation and trials.  We also advise businesses in challenging strategic and transactional matters.

We have a trial-driven approach.  Each case presents a unique problem.  Our goal is to solve it quickly and efficiently to achieve our client’s objective, either in court or through creative mediation strategies.  Either way, we know the best outcomes are achieved by lawyers who, from day one, prepare for trial.  As a result of our trial-driven approach, we focus on what counts – the essential facts, documents and witnesses that will determine the outcome.  Thus, not only do we avoid needless pretrial disputes and discovery costs but, by being prepared to see each case through to trial, we are always positioned to negotiate the best settlement, including before litigation even begins.

We have track records of success.  The firm’s founding partners, M. Todd Parker and David M. Pohl, have established track records of success and backgrounds at elite law firms and federal clerkships.  They have won cases in state and federal courts, in jury trials and arbitrations. They have repeatedly been recognized for distinction as business litigators by Super Lawyers magazine, the Thomson Reuters publication honoring top lawyers in New York based on factors including achievement and peer review.  They regularly take on some of the biggest law firms in New York City and, in other cases, work alongside them.

We are invested.  We think the best outcomes are achieved by small teams of experienced and trial-ready attorneys invested in their clients’ success.  No junior attorneys “cut their teeth” on our cases.  Staffing cases only with proven, experienced lawyers who are invested and focused ensures that our clients get the best possible value.

We collaborate.  Our partners work collaboratively on each matter entrusted to us.  As a result, each of our cases and clients benefits from their combined experience and skill, and from a collaborative process that yields superior work product, strategy and execution.

Flexible and Innovative Fee Arrangements

Mindful of each client’s unique situation and need for a cost-effective result, we offer:

Flat Fees – for individual tasks, stages of litigation or an entire case or matter.
Hourly Fees – reasonable hourly rates and value billing.
Contingency Fees – arrangements that tie our compensation to the results we achieve.
Blended Fees – combinations of flat, hourly and contingency fees to create a structure that meets client needs.

Corporate and Transactional

In addition to our dispute resolution practice, the firm has broad corporate and transactional capabilities, handling a variety of venture capital, finance, M&A and other day-to-day transactional and operational agreements for our clients.
